1. Acceptance of Terms
These Terms of Service ('Terms') constitute a legally binding agreement between you and EatoZone Services Private Limited ('EatoZone', 'we', 'us', or 'our') governing your use of our Smart Cafeteria Management System platform and related services. By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.
2. Eligibility and Account Registration
To use our Services, you must:
- Be at least 18 years of age or have parental/guardian consent
- Be an authorized employee of a corporate client or an authorized representative for corporate admin access
- Provide accurate, complete, and current information during registration
- Maintain the security and confidentiality of your account credentials
- Promptly update your account information if any changes occur
- Accept full responsibility for all activities under your account
- Not share your account credentials with any third party
- Notify us immediately of any unauthorized access or security breach
3. Use of Services
EatoZone grants you a limited, non-exclusive, non-transferable license to use our Services for:
3.1 Permitted Uses
- Ordering meals and beverages from authorized cafeterias
- Viewing menu items, nutritional information, and pricing
- Managing meal preferences and dietary requirements
- Tracking order history and nutritional intake
- Providing ratings and feedback on meals
- Managing cafeteria operations (for corporate admins)
- Accessing analytics and reports (for authorized users)
3.2 Prohibited Uses
- Violating any applicable laws or regulations
- Impersonating another person or entity
- Interfering with or disrupting the Services
- Attempting to gain unauthorized access to our systems
- Using automated tools to access or scrape the Services
- Transmitting viruses, malware, or harmful code
- Harassing, threatening, or abusing other users
- Posting false, misleading, or defamatory content
- Engaging in fraudulent activities or payment disputes
- Reselling or commercially exploiting the Services
4. Orders, Payments, and Pricing
Terms related to orders and payments:
- All orders are subject to availability and acceptance by the cafeteria vendor
- Prices are subject to change without prior notice and may vary by location
- You authorize us to charge your selected payment method for all orders placed
- Payment must be completed before order fulfillment unless credit facilities are provided
- Corporate subsidies, if applicable, will be automatically applied to eligible orders
- You are responsible for any taxes, fees, or charges imposed by your financial institution
- We reserve the right to cancel orders in case of pricing errors or unavailability
- Promotional offers and discounts are subject to specific terms and conditions
5. Cancellations and Refunds
Our cancellation and refund policy:
- Orders can be cancelled within the specified cancellation window (typically 15-30 minutes before meal time)
- Cancellations after the cutoff time may not be eligible for refunds
- Refunds will be processed to the original payment method within 5-7 business days
- Quality-related complaints must be reported within 24 hours of order receipt
- Refund decisions for quality issues are at the discretion of EatoZone and the vendor
- Subscription fees are non-refundable except as required by law
- Corporate subsidies will be adjusted according to your organization's policy
6. Intellectual Property Rights
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, images, software, and data compilations, are the exclusive property of EatoZone and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content without our prior written consent.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The Services will be uninterrupted, timely, secure, or error-free
- The quality of meals will meet your expectations
- Any errors or defects will be corrected
- The Services are free from viruses or harmful components
- Results obtained from using the Services will be accurate or reliable
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EATOZONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Loss of data or information
- Food allergies, dietary restrictions, or health issues
- Quality, taste, or freshness of meals
- Delays in order preparation or delivery
- Unauthorized access to your account
- Any damages arising from third-party vendors or service providers
9. Indemnification
You agree to indemnify, defend, and hold harmless EatoZone, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, violation of these Terms, or infringement of any third-party rights.
10. Termination and Suspension
We reserve the right to terminate or suspend your account and access to the Services at our sole discretion, immediately and without notice, for:
- Violation of these Terms or applicable laws
- Fraudulent, abusive, or illegal activities
- Non-payment of fees or chargebacks
- Misuse of the Services or disruption to other users
- Upon your request to close your account
- Discontinuation of our Services
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the platform at least 30 days before the effective date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services and close your account.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka. We encourage you to contact us first to resolve disputes amicably. If informal resolution fails, disputes may be subject to binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996.
13. General Provisions
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect
- Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right
- Assignment: You may not assign or transfer these Terms without our written consent
- Entire Agreement: These Terms constitute the entire agreement between you and EatoZone
- Force Majeure: We are not liable for delays or failures due to circumstances beyond our control
